"SHARE THE MOMENT" SWEEPSTAKES RULES
1. NO PURCHASE IS REQUIRED (Void where prohibited by law). All individuals who are legal U.S. residents who have reached the age of majority in the State in which they reside, are eligible to enter except employees, representatives, and agents of Netaya.com, sweepstakes judges and persons domiciled with any of the above.
2. One (1) prize will be awarded among all eligible entrants consisting of one (1) pair of 1.00 Carat TW 14K White Gold Diamond Stud Earrings with a suggested retail value of $2850.00 US. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part.
3. To participate in the sweepstakes, individuals must enter online at www.netaya.com, before 9:00 a.m. Eastern Standard Time (EST) September 29, 2008.To be automatically entered into the sweepstakes: (a) visit the Netaya.com sweepstakes page at: www.netaya.com, read and agree to the sweepstakes rules; (b) complete the registration/entry form; (c) agree that information on registration becomes property of the sponsors. Incomplete or inaccurate registration forms are void. LIMIT ONE ENTRY PER INDIVIDUAL. MULTIPLE ENTRIES WILL BE DISQUALIFIED.
4. Alternatively you can enter by filling out a 3"x 5" card with your name, complete address including zip code, daytime and evening phone numbers, email address (if applicable), and engagement story and mail in a first class postage paid envelope to: Netaya.com Sweepstakes, 31-00 47th Avenue 5th Floor, Long Island City, NY 11101. For mailing entries it must be mailed and postmarked no later than September 10th, 2008.
5. The Prize will be awarded to the first person selected at random from among all eligible entries. The Prize will be delivered to the confirmed winner.
6. The random draw from all eligible entries will be held on September 30th, 2008, at 12:00 p.m.
7. The selected entrant will be contacted by e-mail ONLY at the e-mail address entered on the registration form. If the selected entrant does not respond by e-mail within 5 days of transmission, or if the selected entrant does not comply with the sweepstakes Rules and Regulations, that entrant forfeits any right to the Prize and another entrant will be selected. The Prize is not transferable or convertible to cash and must be accepted as awarded.
8. Sponsors are not responsible for failure for any reason whatsoever of selected entrant to receive notification. Arrangements for the fulfillment of the Prize will be made by Netaya.com which reserves the right in their sole discretion to substitute any and all part of the Prize with a Prize of comparable value.
9. The selected entrant will be required to sign a declaration of compliance with the sweepstakes Terms and Conditions and one or more releases to obtain the Prize. Sponsors are not responsible for any injury or damage to entrant's or any other person's computer system, property or anything stored on or related thereto as a result of participation in, or connection with, this sweepstakes. Entrants release Sponsors from all liability in connection with the sweepstakes and any Prize won.
10. In order to be eligible to win the Prize, the selected of the entrants selected for the Prize must authorize the sweepstakes Sponsors to announce and publish their names, addresses and photographs (without remuneration) in any publicity and also must sign one or more release forms in favor of the Sponsors and declarations of eligibility. The declaration form will state that the selected entrant, has read, understood, and complied with the rules and regulations of the sweepstakes, and that he/she accepts the Prize as offered. Entrants also permit the use of submitted stories to be used on Netaya.com.
11. Failure to comply with all the sweepstakes rules or to sign and return any of the release forms will result in disqualification and another entrant will be drawn from the remaining eligible entries received. A selected entrant will be declared a winner only after meeting all of the above terms and conditions.
12. Sponsors are not responsible for error, omission, interruption, deletion, delay in operation or transmission or unauthorized access to or alterations of entries, or for technical, equipment, network, electronic, computer, hardware or software malfunction or inaccurate transmission of or failure to receive entry by Sponsors, even if it affects ability to enter or entry into this sweepstakes. Sponsors are also not responsible for lost, stolen, misdirected, delayed, destroyed or illegible entries. All submissions become the property of the Sponsors and will not be returned.
13. The decisions of the sweepstakes judges will be final and binding on all entrants. By entering, entrants agree that they have read, understood and agree to these sweepstakes rules and regulations and release the Sponsors from all liability in connection with the sweepstakes and/or any Prizes. This sweepstakes is subject to all applicable Federal, State and Municipal laws and is void where prohibited. It is the winners' responsibility to report Prize value as income on State and Federal taxes.
14. Sponsor reserves the right to amend or terminate all or any portion of this sweepstakes at any time without prior notice. Sponsors reserve the right to substitute a Prize of equal or greater value in the event of non-availability of the Prize for any reason.
15. The name of the winner may be obtained by e-mail sent to customerservice@netaya.com within 120 days after the closing date of the Netaya.com sweepstakes "SHARE THE MOMENT ".
